These Terms and Conditions ("Terms") govern your access to and use of our website, together with any purchases you make through it.

Throughout these Terms, the expressions "Lavender Hill Clothing", "we", "us" and "our" refer to IFR Holdings Ltd trading as Lavender Hill Clothing.


2. Acceptance of these Terms

By accessing or using this Website, creating an account or placing an Order, you confirm that you have read, understood and agree to be bound by these Terms.

These Terms should be read alongside our:

If there is any inconsistency between these Terms and any other published policy, these Terms shall prevail to the extent necessary to resolve that inconsistency.

Business Day means Monday to Friday excluding public holidays in England.

Contract means the legally binding agreement formed between you and us once we accept your Order.

Customer means any person purchasing Products through our Website.

Order means your request to purchase Products from us.

Product means any item offered for sale on our Website.

You agree to notify us immediately if you believe your account has been accessed without your permission.

We may suspend or close accounts where fraudulent or suspicious activity is detected.

We work hard to ensure that all descriptions, images and specifications accurately represent our Products.

However:

  • colours may vary depending upon individual screen settings;
  • natural fibres may display slight variations in colour, texture or finish;
  • measurements are approximate;
  • manufacturing tolerances may occur;
  • packaging may differ from that shown.

These variations do not constitute faults.

We reserve the right to improve or modify Products where this does not materially affect their quality or intended use.


8. Product Availability

All Products are offered subject to availability.

Adding Products to your shopping basket does not reserve stock.

Occasionally Products may become unavailable after an Order has been placed.

Where this occurs we may:

  • contact you regarding an alternative Product;
  • delay dispatch until stock becomes available;
  • cancel the unavailable item and issue a refund.

We shall not be liable for any indirect loss arising from Product unavailability.


9. Pricing

All prices displayed on the Website are shown in the applicable currency and include VAT where required by law unless otherwise stated.

Delivery charges are calculated separately during checkout.

We reserve the right to amend prices at any time.

Price changes will not affect Orders that have already been accepted.

Whilst we endeavour to ensure all pricing is accurate, genuine pricing errors may occasionally occur.

Where an obvious pricing error exists we reserve the right to:

  • cancel the Order;
  • contact you to confirm whether you wish to proceed at the correct price;
  • refund any payment already received.

10. Promotions & Discount Codes

From time to time we may offer promotional discounts or discount codes.

Unless expressly stated:

  • only one promotional code may be used per Order;
  • discount codes cannot be exchanged for cash;
  • discount codes cannot normally be applied retrospectively;
  • discount codes have no cash value;
  • discount codes may exclude selected Products, gift cards or sale items.

We reserve the right to amend or withdraw promotions without notice where reasonably necessary, including where fraud, misuse or technical error is suspected.


11. Placing an Order

By placing an Order through our Website you are making an offer to purchase Products.

Once your Order has been submitted you will receive an acknowledgement email confirming receipt.

This acknowledgement does not constitute acceptance of your Order.

A legally binding Contract is formed only when we dispatch your Products and send you a Dispatch Confirmation email.

We reserve the right to refuse or cancel Orders where:

  • payment cannot be authorised;
  • fraud is suspected;
  • Products become unavailable;
  • pricing errors occur;
  • delivery restrictions apply;
  • we reasonably believe acceptance would breach applicable law.

12. Payment

Payment must be received in full before dispatch.

We accept the payment methods displayed at checkout, which may include:

  • Mastercard
  • American Express
  • PayPal
  • Apple Pay
  • Google Pay
  • Shop Pay
  • Klarna (where available)

Payments are processed securely by third-party payment providers.

We do not store complete payment card details.

13. Delivery

13.1 Delivery Locations

We currently deliver to the United Kingdom and selected international destinations.

Available delivery locations and shipping options are displayed during checkout.

We reserve the right to amend the countries we deliver to without prior notice.


13.2 Delivery Charges

Delivery charges are calculated during checkout and are based on:

  • delivery destination;
  • shipping method selected;
  • order value; and
  • any promotional offers available at the time of purchase.

Any applicable delivery charges will be clearly displayed before you complete your Order.


13.3 Delivery Times

Estimated delivery times are provided for guidance only.

Whilst we make every reasonable effort to deliver within the estimated timescales, delivery dates are not guaranteed.

Delays may occur due to circumstances outside our reasonable control, including but not limited to:

  • customs inspections;
  • courier delays;
  • severe weather;
  • industrial action;
  • public holidays;
  • transportation disruptions.

Where significant delays occur we will endeavour to keep you informed.


13.4 Dispatch

Orders are normally dispatched within the timeframe stated on our Website.

Dispatch times may be longer during:

  • product launches;
  • promotional events;
  • seasonal sales;
  • public holidays; or
  • exceptionally busy trading periods.

Where a Product is on pre-order or temporarily unavailable, the estimated dispatch date will be shown on the relevant Product page where possible.


13.5 Split Deliveries

Where your Order contains multiple Products, we may dispatch items separately if this enables us to deliver part of your Order sooner.

You will not be charged additional delivery costs where we choose to split shipments.


13.6 Failed Deliveries

It is your responsibility to provide accurate delivery details.

We are not responsible for delays or additional costs arising from incorrect or incomplete delivery information provided by you.

If a parcel is returned to us because:

  • the address supplied was incorrect;
  • delivery was refused;
  • the parcel was not collected; or
  • repeated delivery attempts were unsuccessful,

we reserve the right to charge the cost of re-delivery before sending the parcel again.


14. Risk and Ownership

Risk in the Products passes to you once the Products have been delivered to the delivery address specified in your Order.

Ownership of the Products transfers to you once:

  • full payment has been received; and
  • the Products have been delivered.

15. Returns & Refunds

Your statutory rights under the Consumer Rights Act 2015 remain unaffected by these Terms.

The following summary forms part of these Terms.


15.1 Change of Mind Returns

If you are purchasing as a consumer, you have the right to cancel your Contract in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

In addition to your statutory rights, we currently offer a voluntary returns policy allowing eligible Products to be returned within 14 days of delivery, provided that:

  • the Products are unworn;
  • the Products are unwashed;
  • the Products remain in their original condition;
  • all labels and tags remain attached;
  • the Products are returned in suitable packaging.

We reserve the right to refuse returns which do not meet these conditions.


15.2 Returns Postage

Where you choose to use our UK returns service, a charge of £3.95 will be deducted from your refund to cover the cost of the return postage.

You remain responsible for returning Products to us until they have been received at our returns facility.

For international returns, customers are responsible for arranging and paying for return postage unless otherwise required by applicable consumer law.


15.3 Refunds

Approved refunds will normally be processed to the original payment method.

Refunds will be issued as soon as reasonably possible and, in any event, within the timescales required by applicable consumer legislation.

Original delivery charges will only be refunded where required by law.

Where only part of an Order is returned, original delivery charges are generally non-refundable.


15.4 Exchanges

Where available, eligible Products may be exchanged for an alternative size or colour.

Exchanges remain subject to stock availability.

Where an exchange cannot be fulfilled, we reserve the right to issue a refund instead.


15.5 Non-Returnable Products

Unless faulty or otherwise required by law, we cannot accept returns for:

  • gift cards;
  • personalised or customised Products;
  • sealed items where the seal has been broken and which are unsuitable for return for hygiene reasons;
  • any Products clearly identified as non-returnable at the time of purchase.

16. Faulty, Damaged or Incorrect Products

Nothing in these Terms affects your statutory rights.

If your Product:

  • arrives damaged;
  • develops a manufacturing fault; or
  • is not as described,

please contact our Customer Services team as soon as reasonably possible.

Where a Product is confirmed to be faulty, we will, in accordance with your statutory rights:

  • repair the Product (where appropriate);
  • replace the Product;
  • offer a price reduction; or
  • provide a refund.

We may request photographs or ask that the Product is returned for inspection before determining the appropriate remedy.

Normal wear and tear, accidental damage, misuse or failure to follow care instructions are not considered manufacturing faults.


17. International Orders

Customers ordering outside the United Kingdom acknowledge that:

  • local import duties;
  • customs charges;
  • VAT;
  • handling fees; and
  • other local taxes

may be payable upon import into the destination country.

These charges are imposed by local customs authorities and are outside our control.

Unless expressly stated otherwise at checkout, all such charges are the responsibility of the customer.

Customers are responsible for complying with all import laws and regulations applicable in their destination country.

Where a parcel is refused due to unpaid customs charges, we reserve the right to deduct any costs incurred from any refund due.

18. Promotions, Offers & Gift Cards

18.1 Promotions

From time to time we may run promotions, sales or special offers.

Unless otherwise stated:

  • offers cannot be used retrospectively;
  • only one promotional code may be redeemed per Order;
  • promotions cannot be exchanged for cash;
  • promotions may exclude selected Products, sale items or gift cards;
  • promotions may be withdrawn or amended at any time where reasonably necessary.

Where a Product purchased using a promotional offer is returned, any refund will reflect the price actually paid.


18.2 Gift Cards

Where gift cards are offered:

  • gift cards are non-refundable;
  • gift cards cannot be exchanged for cash;
  • gift cards may only be redeemed through our Website unless otherwise stated;
  • gift cards remain valid for the period specified at purchase.

Lost, stolen or expired gift cards cannot normally be replaced.


19. Product Care

Our Products are made using carefully selected natural and premium fibres.

To maximise the life of your garments you should always follow the care instructions attached to each Product.

We cannot accept liability for damage caused by:

  • incorrect washing;
  • tumble drying where prohibited;
  • bleaching;
  • alterations;
  • misuse;
  • normal wear and tear.

20. Website Availability

Whilst we make every effort to ensure the Website remains available, we do not guarantee uninterrupted access.

The Website may occasionally be unavailable due to:

  • scheduled maintenance;
  • upgrades;
  • technical issues;
  • security updates;
  • circumstances beyond our reasonable control.

We reserve the right to modify, suspend or discontinue any part of the Website without liability.


21. Intellectual Property

All intellectual property rights relating to the Website and our Products remain owned by IFR Holdings Ltd or our licensors.

This includes, but is not limited to:

  • the Lavender Hill Clothing name;
  • logos;
  • branding;
  • product names;
  • photographs;
  • videos;
  • illustrations;
  • graphics;
  • website design;
  • product descriptions;
  • written content;
  • software;
  • trademarks;
  • copyrights;
  • design rights.

Nothing in these Terms transfers any intellectual property rights to you.


21.1 Permitted Use

You may:

  • browse the Website;
  • print pages for your personal use;
  • purchase Products for your own personal use.

You may not:

  • copy Website content for commercial purposes;
  • reproduce Product photography;
  • reproduce our marketing material;
  • remove copyright notices;
  • use our trade marks without written permission.

22. User Reviews & Customer Content

If you submit:

  • reviews;
  • photographs;
  • testimonials;
  • social media content;
  • comments;

you confirm that:

  • the content is your own;
  • it does not infringe another person's rights;
  • it is accurate to the best of your knowledge;
  • it is not unlawful, abusive or defamatory.

By submitting content to us or tagging Lavender Hill Clothing on social media where you expressly permit us to share it, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that content for marketing and promotional purposes.

If you no longer wish us to use your content, please contact us and we will consider your request promptly.


23. Privacy

Your privacy is important to us.

We process personal information in accordance with:

  • the Data Protection Act 2018; and
  • our Privacy Policy.

24. Limitation of Liability

Where permitted by law, our total liability arising from any Order shall not exceed the amount paid by you for the relevant Products.

25. Events Beyond Our Reasonable Control

We shall not be liable for any delay or failure to perform our obligations where this results from circumstances beyond our reasonable control, including but not limited to:

  • natural disasters;
  • severe weather;
  • industrial disputes;
  • war;
  • terrorism;
  • pandemic or epidemic;
  • government action;
  • transport disruption;
  • courier failures;
  • internet or telecommunications failures.

We will use reasonable endeavours to minimise any delay.

The version published on our Website at the time you place your Order will apply to that Order.


27. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be severed and the remainder of the Terms shall remain in full force and effect.

These Terms, together with our Privacy Policy, Shipping Policy, Returns & Refund Policy and any other policies expressly referred to, constitute the entire agreement between you and us regarding your purchase of Products through the Website.


29. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising from these Terms or the use of this Website shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws provide otherwise.
